PROTECTING YOUR ASSETS:
DEATH, DIVORCE & RE-MARRIAGE
All marriages come to an end, either through the death of a spouse or divorce. Wouldn’t you want peace of mind knowing that family assets are protected and children provided for? Victoria Melling of KBL Solicitors explains
Making sure you have current Wills and/or planning a Pre-Nuptial Agreement (prior to marriage) will ensure that assets are distributed in accordance with your wishes should the worst come to the worst.
The number of families experiencing divorce and re-marriage is increasing, in such a scenario you and your new spouse will want to ensure that children/family members are provided for. Once the new marriage is formalised any existing Will is revoked, which can develop into a problematic and emotional situation for all concerned. The best way to avoid this is by taking the necessary steps before the wedding.
Taking the right advice at the right time secures a seamless transition of testamentary wishes through the marriage contract and beyond. When considering how things should be handled upon your death, protection for your children can be provided in several ways, including via Trusts. The right planning will ensure equality between your children and new spouse, leaving everyone represented fairly.
Timing is key and something to consider, whether it’s your first or your fifth marriage, is a Pre-Nuptial Agreement – particularly important if you wish to protect assets for yourself and/or your children. Adding a Pre-Nuptial Agreement to your wedding ‘to-do list’ will make life simpler for you and your spouse. Many couples and families take out insurance when planning their wedding to protect themselves financially should something go wrong – so why wouldn’t you protect yourself against the marriage going wrong?
